Welcome to the Optimal Breathing Affiliate Program!

This Affiliate Program is a partnership between Optimal Breathing, LLC (“we”, “us” and “our”) and affiliates (“affiliate”, “you”). The following terms and conditions apply to individuals who are accessing or using the Program.

By participating in the Affiliate Program, the affiliate agrees to use the Program in the manner specified in and is bound by these Terms and Conditions. If you do not agree to these Terms and Conditions in their entirety, you are not authorized to register as an affiliate or participate in the Program in any manner.

Definitions

• “Affiliate” or “Affiliates” are the individuals or entities in the affiliate application that intend to participate in the Affiliate Program and who will legally be bound by the Terms and Conditions herein.

• “Affiliate Program” means the program operated by Optimal Breathing, LLC, to which the Affiliates are enrolled and rewarded in the form of monetary compensation for referring customers. 

• “Affiliate Link” is the personal link from an affiliate participating in the affiliate program, used to track referrals and commissions. The link is located at the affiliate’s website and promotional channels, and when clicked on by a potential customer, it directs to www.optimalbreathing.com. 

• “Commission” means the money that an affiliate earns from each referral that converts into a sale

Subject to the terms and conditions of this Agreement, Optimal Breathing, LLC hereby grants to the Affiliate Partner during the term a limited, non-transferable, revocable and non-exclusive right to market and refer Optimal Breathing’ Products and/or Services to prospective customers.

Eligibility

To be eligible to join the Affiliate Program, you must be at least 18 years old and have a website/social media platform/other online presence and not be engaged in any activities that could damage the reputation of Optimal Breathing, LLC or its products.

Approval/Rejection of the Registration

We reserve the right to approve or reject ANY Affiliate Program Registration in our sole and absolute discretion. You will have no legal recourse against us for the rejection of your Affiliate Program Registration.

Affiliate Responsibilities 

• You may promote our products in any ethical and legal way, through your website, social media platforms, email marketing, or other approved channels.

• You must clearly disclose your affiliation with us and ensure all promotional materials comply with applicable laws and regulations.

• You are prohibited from engaging in misleading or deceptive practices, spamming, or making false or unsubstantiated claims about our products.

• You shall not engage in activities that may harm the Company’s reputation or violate any laws. 

• You will earn a commission for each sale generated through your unique affiliate link or tracking code. The commission rate will be 15% of the purchase price. This commission will be awarded to you for any purchases made within 90 days of a visitor clicking on your affiliate link. If the visitor clicks on someone else’s referral link and then later they click on yours, yours is the one that counts.

• Affiliate commissions will be processed and released 45 days after the order delivery date to verify the order's completion and account for potential returns or cancellations.

• Payments are made into your PayPal account unless otherwise specified. You don’t need to have a business account. A standard PayPal account is acceptable.

• Either party may terminate the affiliate relationship at any time with notice.

• We reserve the right to terminate affiliates for violation of these terms, including fraudulent activity.

• We are responsible for any indirect, special, or consequential damages arising from affiliate participation. 

• By participating in the Affiliate Program, you acknowledge and agree to indemnify, defend, and hold our company harmless from any claims or damages arising out of your participation in the program.

We reserve the right to amend this agreement at any time. We will notify you of any changes by posting them on our website (OptimalBreathing.com) or Affiliate Program platform.
